When these terms apply
These terms describe the standard personal-use license for digital artwork offered by Manhattan Girl when the relevant listing and checkout present or incorporate them before purchase. A product’s description and any expressly agreed license identify the artwork and permitted use for that purchase.
The gallery may display previews before an artwork is available to buy. A preview alone is not an offer to sell or a promise that a particular format, size or delivery option is available.
If you purchase through Etsy or another platform, the seller identified at checkout, the listing, that platform’s rules and applicable consumer law govern the transaction. These terms apply only where the listing or checkout expressly incorporates them. They do not override mandatory consumer rights.
What your purchase includes
A listing marked “digital download” includes only the digital file or files described in that listing. It does not include a physical print, frame, mat, furniture or shipping unless the listing expressly states otherwise. The listing should identify the file format, dimensions, resolution and available print sizes before you pay.
Room scenes, frames and styled interiors show possible display ideas. They do not establish the actual size of the artwork or mean that the objects pictured are included. Colors can vary with screens, printers, ink and paper. Please check the stated specifications before purchasing.
For a physical print or a custom commission, any separate terms for production, delivery, cancellation and returns must be shown with that product before purchase. These digital-download terms do not create a blanket no-refund rule for those products.
Your personal-use license
When these terms form part of your purchase, you receive a non-exclusive license to download and retain the purchased file, make a backup, and print copies for your own personal display. You may provide the file to a print service solely to produce your permitted personal copies.
You may give an individual physical print as a personal gift, but you may not distribute the digital file or sell printed copies. Buying a download does not transfer ownership of any copyright or give you an exclusive right to the image.
Any wider use, including business display or commercial reproduction, requires a separate written agreement from Manhattan Girl before that use.
Sharing, resale and commercial use
Under this purchase license, you may not share, upload, sublicense, sell or distribute the digital file; place it in a publicly accessible download folder; sell prints or merchandise using it; or make it available through a stock-image service, print-on-demand store or other resale service. Do not remove an included rights notice or claim authorship of the purchased artwork.
These restrictions describe the agreement with a buyer who accepts this license. They do not create intellectual-property rights where the law does not recognize them, or limit uses that applicable law requires us to allow.
Artwork and creative tools
Artwork may incorporate photography, digital illustration, editing and AI-assisted elements. Any description of an artwork’s medium should be read with the individual listing. An illustrated preview should not be understood as a claim that a work is entirely hand-painted, a documentary photograph, or a unique physical original.
Manhattan Girl grants only rights it owns or is authorized to grant. Copyright protection for particular creative elements depends on applicable law. Third-party marks and other third-party rights are not transferred by an art purchase.
Delivery and printing
The listing and checkout should explain how and when you will receive the files. Follow those instructions and retain your order confirmation. You are responsible for using compatible software and choosing a print size and service appropriate for the supplied file.
If a download is inaccessible, missing, corrupted or materially different from the listing, contact the seller promptly with your order details. For a direct Manhattan Girl order, use our contact form. Do not send card numbers or other payment credentials.
Refunds and consumer rights
For digital files sold directly by Manhattan Girl under these terms, we generally do not offer a change-of-mind refund once the files have been delivered or made available for download, except where required by law or expressly offered in the listing.
If we cannot supply the purchased file, or it is faulty or materially different from its description, we will provide an appropriate remedy, such as a correct replacement or a refund, as required by applicable law. This policy does not remove rights for faulty, misdescribed or undelivered products.
Where a jurisdiction requires express consent to immediate digital delivery and acknowledgement of a resulting loss of a cancellation right, that consent and acknowledgement must be obtained at checkout. These terms alone do not waive that right. Purchases through Etsy or another platform are also subject to its applicable purchase and refund rules.
